Waste Electrical & Electronic Equipment (WEEE) Regulations 2006
Commencing 1 July 2007 any business that manufactures, brands or imports electrical and electronic equipment are responsible for the cost of collection, treatment and recycling of obligated WEEE generated in the UK. The regulations also affect distributors and retailers of EEE as well as end users.
Producer Compliance
The WEEE Regulations are intended to transfer the responsibility (and the cost) of dealing with electrical and electronic equipment (EEE) at the end of its life, from the user to the producer. You are a producer if you:
- Manufacture EEE and place it on the UK market under your own brand
- Rebrand EEE manufactured by someone else and place it on the UK market
- Import EEE from outside the UK and place it on the UK market
As a producer, there are several requirements you have to meet:
- You must join a Producer Compliance Scheme (PCS) by 15/03/07
- You must supply information on your 2006 sales of EEE to the PCS so that they can report this data to the Environment Agency by 01/04/07
- You must fund (via the PCS) the collection, treatment and recycling of WEEE
- You must mark your products with a crossed out wheelie bin, a producer identification mark and a date mark
- You must keep records of the EEE you have put on the market
- You must provide information about your products to recyclers to enable safe and effective treatment at the end of its life.
Retail Compliance
You are a retailer or "distributor" under the WEEE regulations if you sell Electrical or Electronic Equipment (EEE) to end-users in the UK, however you sell them, e.g. through retail facilities, by mail or internet order etc. You do not have any financial responsibilities for ensuring WEEE is recycled or treated, but:
As a distributor of household EEE you must:
Facilitate the take-back of household WEEE by either:
- Allowing WEEE from private households to be returned to you in store, or
- Joining the Distributor Takeback Scheme.
If the latter, you must provide information on the facilities available to consumers for the separate collection of household WEEE in you area, and provide information to customers on the environmental aspects of the products when they become waste.
